Terms & Conditions

Last Updated 10 December 2020.

These terms of use set out the terms of use on which you may make use of our website https://www.talked.com.au (our site). Use of our site includes accessing, browsing, or receiving consultations through our site.

Please read these terms of use carefully before you start to use our site, as these will apply to your use of our site. We recommend that you print a copy of these terms for future reference.

By using our site, you confirm that you accept these terms of use and that you agree to comply with them.

If you do not agree to these terms of use, you must not use our site.

"Talked", "us", "company", "we" and "our" refer to Talked Pty Ltd (ACN 640 295 272).

Our liability

All of our therapists are self-employed and are regulated by their respective regulatory bodies. Each therapist has their own set of terms and conditions, and any therapeutic contract will be formed between you and your chosen therapist.

Talked provides the platform and administrative services only. Talked will not accept liability for any loss or damage resulting from contact or work with the therapist. Any complaint against the therapist should be raised with the therapist in the first instance and, if necessary, escalated to their respective member organisation.

Changes to these terms

We may revise these terms of use at any time by amending this page.

Please check this page from time to time to take notice of any changes we made, as they are binding on you.

Changes to our site

We may update our site from time to time, and may change the content at any time. However, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it.

We do not guarantee that our site, or any content on it, will be free from errors or omissions.

Use license

Permission is granted to temporarily download one copy of the materials (information or software) on Talked’s website for personal, non-commercial transitory viewing only. This is the grant of a licence, not a transfer of title, and under this licence you may not:

  • modify or copy the materials;
  • use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  • attempt to decompile or reverse engineer any software contained on Talked's website;
  • remove any copyright or other proprietary notations from the materials; or
  • transfer the materials to another person or "mirror" the materials on any other server.

This licence shall automatically terminate if you violate any of these restrictions and may be terminated by Talked at any time. Upon terminating your viewing of these materials or upon the termination of this licence, you must destroy any downloaded materials in your possession whether in electronic or printed format.

No reliance on free information

The free content on our site (in particular the free therapy guide) is provided for general information only. It is not intended to amount to advice on which you should rely or a tool for diagnosis. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the free content on our site.

Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up-to-date.

Limitations

In no event shall Talked or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Talked's website, even if Talked or a Talked authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Uploading content to our site

Whenever you make use of a feature that allows you to upload content to our site, or to make contact with any person through our site, you must comply with the Acceptable Use Policy content standards.

You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty.

Any content you upload to our site will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such content for any purpose.

We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of our site.

We have the right to remove any posting you make on our site.

The views expressed by contributors on our site do not necessarily represent our views or values.
